This Acceptable Use Policy (“AUP”) outlines the guidelines and restrictions that govern your use of Coworked Inc.’s (“Coworked,” “we,” “our,” or “us”) services, including Harmony, our AI Project Manager, and any related products or services (collectively, the “Services”). The purpose of this AUP is to ensure that all users of our Services operate in a responsible, lawful, and respectful manner.

By accessing and using our Services, you agree to adhere to this AUP. This AUP is incorporated by reference into and made a part of our Terms of Service. If you do not agree to comply with this AUP, you may not use the Services. This AUP shall be read with the Terms of Service available at https://www.coworked.ai/terms-of-service and the Privacy Policy of the Coworked available at https://www.coworked.ai/privacy-policy.

Coworked reserves the right to modify this AUP from time to time in order to reflect updates to our practices, technology, or changes in applicable laws. We will notify you of any significant changes to this AUP via the Services or email, as appropriate. Continued use of the Services after any updates constitute your acceptance of the revised AUP.

Universal Policies

We want Harmony, our AI Project Manager, and other related Services to be used in a manner that promotes trust, safety, and responsibility. The following universal policies apply to all users of our Services:

1. Compliance with Laws

You must use our Services in compliance with all applicable laws, regulations, and industry standards. This includes but is not limited to:

• Intellectual Property Laws: You may not use our Services to infringe on the intellectual property rights of others, including copyrights, trademarks, patents, and trade secrets.

• Privacy Laws: You must respect the privacy rights of others and ensure you have obtained the necessary consents if you collect, store, or process personal data.

• Regulatory Requirements: If your use of the Services is subject to specific regulatory requirements (such as those governing financial data or healthcare), you must ensure compliance with those laws.

AI-specific regulations: Users must comply with applicable Artificial Intelligence (AI) governance frameworks, including but not limited to transparency requirements, algorithmic accountability standards, and AI-specific regulations.

2. No Harmful or Malicious Activities

You are prohibited from using our Services in a way that harms others, including:

• Fraud and Deception: Do not use the Services to engage in fraudulent activities, create scams, or impersonate others.

• Harassment: You may not use the Services to harass, bully, or intimidate individuals or groups, or to promote hate, violence, or discrimination.

• Malware and Security Breaches: You may not distribute malware, viruses, or engage in activities that compromise the security of Coworked’s systems or other users. You may not use Harmony in a manner that could cause harm to systems, including creating malicious code, distributing viruses or malware, or launching denial-of-service attacks.

• Fraud: You may not use the platform to promote fraud or spread harmful content.

3. Responsible Use of Outputs

When using Harmony’s outputs or other Services provided by Coworked, you are responsible for ensuring the accuracy and legality of the information generated. You acknowledge that outputs or other Services provided by Coworked may contain errors, inaccuracies, or biases. You are solely responsible for reviewing, verifying, and validating all outputs from Harmony before relying upon such content. You assume all risks associated with the use of the outputs including but not limited to accuracy, completeness, reliability, and legal compliance. Coworked makes no warranties regarding the accuracy or suitability of such outputs for any particular purpose. You may not:

• Repurpose or distribute outputs to defraud, mislead, or cause harm to others.

• Use outputs for deceptive, misleading, or malicious purposes.

4. No Circumvention of Security Measures

You are prohibited from attempting to circumvent or bypass any security measures in place to protect our systems or other users. This includes:

• Unauthorized Access: You may not attempt to gain unauthorized access to any part of our Services or systems.

• Account Security: You are responsible for maintaining the security of your account and must not share your credentials with others or allow others to access your account.

5. Project Management with Harmony

When using Harmony, our AI-powered project management platform, you must adhere to the following guidelines to ensure responsible and lawful use of the Services:

User Safety

We do not allow content or activities on Harmony that:

• Violates laws or promotes illegal activities: You may not use Harmony for any illegal activity, including fraud, hacking, or engaging in unlawful behavior.

• Contains sexually explicit or exploitative content: Especially in relation to minors, any inappropriate or explicit content is strictly prohibited.

• Is defamatory, fraudulent, or libelous: Misusing the platform to defame, promote fraud, or spread harmful content is not allowed.

• Promotes discrimination or abuse: You may not use Harmony to target individuals or groups based on race, religion, gender, age, nationality, or sexual orientation with discriminatory or abusive content.

• Disseminates false or misleading information: Intentionally posting deceptive, false, or inaccurate information is not allowed.

• Harasses or harms others: Using Harmony to harass or harm any individual, including employees or other users, is prohibited.

• Incites violence or terrorism: Content that promotes, encourages, or incites violence or terrorist activities is strictly forbidden.

• Undermines democratic processes: Any activity that threatens democratic processes or institutions is not allowed.

Privacy

• Consent for data processing: You may not use Harmony to collect, store, share, or process personal data without obtaining all necessary legal bases for such processing under applicable data protection laws, including but not limited to informed consent, contractual necessity, or legitimate interests, as required by laws such as GDPR, CCPA, or equivalent regulations in your jurisdiction. You must not collect, process, or store information from minors without appropriate parental or guardian consent.

• Respect privacy: You are prohibited from generating or sharing content that violates the privacy of others, such as posting someone’s personal information without their permission.

• No spyware or surveillance: You may not use Harmony to facilitate spyware, unauthorized monitoring, or communications surveillance of individuals.

• Confidentiality: You must respect confidentiality agreements and refrain from disclosing sensitive information through Harmony.

Intellectual Property

• Respect intellectual property rights: Users must not use Harmony to infringe upon the intellectual property rights of others, including copyrights, trademarks, patents, and publicity rights.

• Do not reverse-engineer: You are prohibited from reverse-engineering, reproducing, or attempting to recreate Harmony or its underlying algorithms, as well as crawling, scraping, or harvesting data unless explicitly allowed by applicable law.

• No competitive use: You may not use Harmony as part of an effort to compete with Coworked or to build a competing product.

Spam or Inauthentic Activity

We do not allow users to:

• Send spam or unsolicited communications: You may not use Harmony to send unauthorized advertisements, spam, or unsolicited messages.

• Propagate abuse or disinformation: Using Harmony to spread abuse on other platforms or participate in disinformation campaigns is strictly prohibited.

• Engage in phishing: Using Harmony for phishing or attempted phishing activities is not allowed.

• Create misleading content: You may not generate or share content that you know is false or misleading.

• Impersonate others: Misrepresenting yourself, including suggesting that Harmony-generated output is human-created when it’s not, is not allowed.

Site Access & Safety

• Avoid technical harm: Users may not use Harmony in a manner that could cause harm to systems, including creating malicious code, distributing viruses or malware, or launching denial-of-service attacks.

• Restricted access: Access to Harmony is limited to authorized users who have agreed to the Terms, and users may not share account credentials with others or grant unauthorized access.

• No unauthorized access: Attempting to gain unauthorized access to Coworked’s systems or data, or circumventing security measures, is prohibited.

User Protection

• Do not harm others: You must not engage in any activities on Harmony that could adversely impact or harm other users, such as harassment, exploitation, or discrimination.

• Avoid harmful decisions: You should not use Harmony to make decisions that could materially or legally affect an individual.

• Report misuse: Users should promptly report any misuse or abuse of Harmony to ensure a safe environment for all users. Such issues shall be reported to:  [email protected]

• Avoid harmful content generation: You must not use Harmony to generate content that could negatively affect or harm others.

Services Usage Limits

• No unauthorized reproduction: You may not reproduce, duplicate, copy, sell, or resell any part of Harmony without permission.

• Adhere to usage limits: Users must comply with the usage limits outlined in their subscription or licensing agreement.

General Disclaimer

COWORKED SERVICES ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED AND YOUR USE OF THE SAME IS OTHERWISE AT YOUR OWN RISK. THE SERVICES ARE NOT INTENDED TO PREVENT OR PROTECT AGAINST SECURITY INCIDENTS. COWORKED DOES NOT MAKE, AND HEREBY DISCLAIMS, ANY AND ALL OTHER EXPRESS AND/OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT AND TITLE, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE. COWORKED DOES NOT WARRANT THAT THE SERVICES ARE OR WILL BE UNINTERRUPTED OR ERROR FREE. YOU AND YOUR AUTHORIZED USERS ACKNOWLEDGE AND AGREES THAT THE SERVICES: (a) MAY HAVE ERRORS (OR “BUGS”) AND MAY ENCOUNTER UNEXPECTED TECHNICAL PROBLEMS. ACCORDINGLY, FROM TIME TO TIME, YOU MAY EXPERIENCE DOWNTIME AND ERRORS IN THE OPERATION, FUNCTIONALITY OR PERFORMANCE OF THE SERVICES; AND (b) MAY INCLUDE THIRD-PARTY INTEGRATIONS, OPEN SOURCE SOFTWARE (OR "OSS"), PRODUCTS AND/OR SERVICES CONTROLLED BY THIRD PARTIES WHICH ARE SUBJECT TO CHANGE FROM TIME TO TIME WITHOUT NOTICE AND PROVIDED UNDER THE TERMS OF SUCH THIRD PARTY. ANY THIRD-PARTY CODE THAT MAY BE PART OF ANY EXTERNAL API FEED WILL NOT INVOKE THE INDEMNIFICATION RESPONSIBILITIES OF, OR IMPART LIABILITY UPON, COWORKED.

Recommended Practices

• Implement human review: For sensitive or high-stakes use cases, such as developing new products or services, we encourage users to review outputs to ensure accuracy and reliability.

• Data protection and ethical use: Users should follow best practices for data protection and ensure the ethical use of AI-generated content from Harmony.

• Provide feedback: To help us improve Harmony, users are encouraged to provide feedback and report any issues to [email protected] for product-related feedback or [email protected] for potential security concerns.

Changes

Policy updates: Coworked reserves the right to update this Acceptable Use Policy at any time. If changes are made, an updated version will be posted on our website, unless a different type of notice is required by law.
